If two or more persons work together to make an invention, to whom will the patent be granted?
The starting point is the only person that can file for a patent is the inventor. And so, it’s a fact question. You can’t add your mom on the patent application because you love her, and you can’t keep her off of it if it was really her idea. So, if two or more people work on the invention, Inventor One says to Number Two, “Hey, I’ve got Idea X.” And Inventor Two says, “Hey, that’s a cool idea.” You have one inventor. If Inventor One says, “X,” and Two says, “Y,” and One says “W,” now you have co-inventors and they both own the invention.
